Series & Ad Hoc Group Tours Terms & Conditions Agreement

The purchase of Series & Ad Hoc Group Tours offered by Dina Travel Sdn Bhd (also referred to as “Dina Travel”) constitutes a contractual agreement between Customer/ Passengers (also referred to as “Tour Member”) and Dina Travel. This represents your acceptance of Dina Travel’s Terms & Conditions as outlined below.

Tour Member is required to carefully read and understand these conditions prior to confirm your booking.

This Series & Ad Hoc Group Tours Terms & Conditions are designed in tandem with the “Jadual Keempat, Subperenggan 6 (1) (m) (ii), Akta Industri Pelancongan 1992” and are as follows:

1. Tour or Package Price Includes
    1. Where applicable, a return Economy or Business Class flight air ticket which is non-refundable and non-reroutable including airport taxes, fuel surcharges and other relevant charges imposed by relevant governmental authorities, unless specified otherwise.
    2. Accommodation, land/water transportation/transfers, meals, entrance fees, tipping and other inclusion items are as specified in the official Dina Travel’s program under “Harga Pakej Termasuk”.
    3. The inclusion items are subjected to the Terms and Conditions of the respective service providers, ground operators and the local authorities.
    4. Seats allotment per group are subject to availability and first come first serve basis. Any additional seats request is subject to the airlines fare fluctuation and availability.
    5. In the event of the airlines fuel surcharge or airport taxes increase due to economic reasons and/or the exchange rate exceeds the current rate published below, Dina Travel hold the rights to review and charge the Tour Member with the difference of the tour price:

2. Tour or Package Price Excludes
      1. Exclusions from tour price varies from packages and products. These exclusions could be referred to the “Harga Pakej Tidak Termasuk” section of each program.
      2. Dina Travel also shall not be held liable for the items which is not being mentioned in the “Harga Pakej Termasuk”.
3. Child & Infant Policy
      1. A Child is classified as between the age of 2 and 11 years old and an Infant is classified as below the age of 2 years old at the point of flight departure date.
      2. The Child will be charged accordingly as Child Twin or Child with Bed or Child No Bed, depending on the bed configuration which they will be staying.
      3. In general, the classification age of the child and infant applies to most countries but however, where it differs, Dina Travel will notify the Tour Member through its general publication or in the tour program itself.
      4. The Infant will only be provided and charged for the air component or air fares plus relevant taxes, where applicable. No other services will be provided.
      5. The air component or air fares varies from airlines to airlines: therefore, the infant fares will be quoted when requested.
4. Accommodation
      1. Accommodation is based on half Twin share for adults unless the Tour Member specifically requested for Single or Triple occupancy for their Tour Member.
      2. Single supplement charge will apply for Tour Member traveling alone in a group. Where requested, Dina Travel will assist to couple the Tour Member but shall not be responsible if such arrangement is not possible. Any cancellation of confirmed booking by Tour Member resulted from the inability to pair the Tour Member, cancellation charges as stipulated in clause 8 of these terms will be enforced.
      3. Child With Bed or Child No Bed will be sharing as a third person in a twin or double bedroom of 2 adults.
      4. Where a child is sharing a room with 1 adult, such condition is deemed as the child price being calculated as a Child Twin sharing basis.
      5. Child With Bed is based on either the extra bed may be an additional bed or a roll away bed as determined by the hotel in accordance with policy which the Tour Member have agreed to concur.
      6. Where the name of the hotel is indicated in the tour program, Dina Travel shall endeavour to use its best effort to secure the specified hotel unless for reasons of unavailability or security, an alternate hotel within the same classification shall be confirmed. Dina Travel shall not be held liable for the change of hotel.
5. Request for Extension or/ and Deviation
      1. Request for extension or/and deviation from the original flight planned or date of travel is subjected to the airlines’ ticket restrictions, terms & conditions and the applicable charges or additional fares.
      2. Tour Member to ensure that such request is made and agreed prior to the confirmation of tour booking.
      3. In the event the tour booking is made, and deposits have been paid, the cancellation of the tour booking resulted from the failure to arrange the extension or/and deviation, the cancellation policy as per clause 8 of this Terms & Conditions shall apply.
      4. Any extension or/and deviation arrangement shall be at the Tour Member’s sole responsibility and Dina Travel shall not be held responsible for any caused, damages or additional costs incurred resulted from the extension or/and deviation arrangement.
6. Booking Fees
      1. In the event of the Tour Member participates in Travel Fairs such as Matta Fair and/or any other events organized by Dina Travel or tourism bodies or the airlines or affiliates, a non-refundable Booking Fees will be collected during these events as schedule below:

      1. Private Tour Members must made 50% booking for ground cost, and full amount or 100% of the total of flight costs/ fares.
      2. The Booking Fees amount paid would be lessen from the amount due for Deposits except for Private Tour Package.
      3. The Booking Fees payment should be made to Dina Travel within 3 days upon confirmation, otherwise the booking will be cancelled.
7. Deposits & Full Payments
      1. Deposits & Full Payments are non-refundable unless cancelled in accordance with the schedule and period as per Clause 8.
      2. Tour Member must ensure that the Deposits are paid accordingly to deadline below upon receiving the Proforma Invoice and in accordance with the schedule below:

      1. Private Tour Members, deposit for Flight Costs must be made in-full amount or 100% of total flight fares or costs and 50% deposit for ground package.
      2. The Deposits amount paid would be lessen from the amount due for Full Payments except for Private Tour Package.
      3. Deposits payment deadline is minimum 60 days before departure, unless specified otherwise in the tour program.
      4. Full Payments deadline is minimum 45 days before departure unless specified otherwise in the tour program.
      5. For any Tour Confirmation within 45 days before departure, Full Payments deadline is 3 days after booking is confirmed
8. Cancellation, Cancellation Fees & Refunds
      1. Cancellation of tour booking could arise under the following circumstances:
        1. By failure to abide to the stipulated Deposits or Full Payments deadline imposed by Dina Travel as per clause 7 of this Terms and Conditions.
        2. By Tour Member after the Booking Fees, Deposits or Full Payments have been made.
      2. Notice for the cancellation of Tour Booking by Tour Member must be made in writing or email to avoid any miscommunication. The date where the notice is received by Dina Travel will be the basis for the calculation of penalty charges.
      3. Where refund is eligible, the processing period by Dina Travel will be within 90 days from the date of the refund request.
      4. All deposits and full payments made are non-refundable beyond the cancellation period. Exceptions are as follows:
        1. Death – accompanied with the death certificate.
        2. Hospitalized or medical reasons – accompanied with the letter from hospital (letter from general practitioners are not acceptable).
        3. Exceptions as per clause 8 (d) are subjected to the sole approval from Dina Travel which highly dependent on the airlines and relevant suppliers’ discretion, and such refund, if approved, may differ from the amount Tour Member has paid.

      1. Private Tour Members, In the event of cancellation, Flight Fare/Cost will be 100% Forfeited and as for ground cost will be as table above (Cancellation Charges /Fees) and admin charges will be imposed as table 8(f).
      2. In the event if the cancellation is done 60 days or more before the departure date, the deposit will be refunded less the stipulated administrative charges as the schedule below:

      1. Credit card refunds will be made through the Tour Member’s credit card in 40 days after the appeal for refund being approved by Dina Travel administrative.
      2. An additional 3% administrative charge will be imposed for all credit card refunds.
9. Payments to Dina Travels
      1. All payments to Dina Travel should be made via online transfers, cash bank in or cross cheque bank into below account details:

      1. Cheque bank in will only be accepted if the payment is made at least 7 working days before the stipulated deadline into Dina Travel account either by hand or Maybank ATM.
      2. Dina Travel will never hire or appoint the staff or any representative on behalf company to collect or accept any cash payment from Travel Agent/ Tour Member’s. All cash payment should be made directly into the Dina Travel’s bank account.
10. Flight Timings and On Time Performance
        1. Flight timings and schedules are not guaranteed and do not form part of the contract. All flight schedules are subject to change or cancellation by the airlines or regulatory body of the country. Dina Travel shall use its best effort to rearrange the tour or flight, enabling the Tour Member to proceed with the tour.
        2. Pursuance to item 10 (a), Dina Travel shall not be held liable or responsible for any cancellation or additional charges resulted from such change or cancellation of the flight schedule by the airline or regulatory body.
11. Group Buy-up
        1. A Group Buy-up is defined as a situation where a Tour Member purchases all the seats in a series departure group. Partial or half-group seat purchases are NOT considered as group buy-ups.
        2. The payment terms for booking fees, deposits, full payments, and/or name list submission might be different from our standard series group terms and conditions. The terms for the Group Buy-up will be stated in the confirmation sent by our reservation team.
        3. A Group Buy-up is subject to the minimum number of passengers required to depart, set by Dina Travel, and subject to the materialisation rate (MR) required by the airlines as stated in the confirmation email.
        4. Failure to fulfil the group materialisation rate (MR) will Result in a penalty, and the penalty amount will be subject to Dina Travel terms with the airlines.
12. Cancellation of Group Tours
        1. Cancellation of the entire series or ad hoc group tours are possible by either Dina Travel and/or the Tour Member. Details that encompass such cancellation are as follows:
          1. Force majeure – Act of God, War, Pandemic.
          2. Strike, riot, civil war or coup.
          3. Insufficient number of passengers to form a minimum group size of 20.
        2. Further to clause 12 (a) (i) and (ii), it is agreed that the cancellation of series or ad hoc groups will be dependent on the official travel restriction announcement or notice issued by the Malaysian Ministry of Foreign Affairs (herein referred to as “Wisma Putra”).
        3. Further to clause 12 (b), upon the announcement or the issuance of the notice by Wisma Putra, Dina Travel shall offer the Tour Member an alternate destination or process for refund. Where the Tour member opted for refund, it is hereby agreed that the processing time for such refund will be within 65 days.
        4. If the cancellation is being requested by Tour Member for incidents occurred as per Clause 12 (a) (i) and (ii) without the official travel restriction notification issued by Wisma Putra, Dina Travel reserves the right to approve or reject such refund request from the Tour Member and the quantum of refund which may not equal to the tour price paid.
        5. Further to Clause 12 (a) (iii), Dina Travel shall refund to Tour Member the tour price paid in full.
        6. The decision by Dina Travel shall be final and conclusive.
13. Tour Member Responsibilities
          1. Passport
            1. Tour Members is responsible to ensure he/ she possess a valid international passport with a minimum validity of 6 months from the date of return.
            2. The main page of the passport must be emailed or faxed to Dina Travel upon receiving the Tour Confirmation enabling Dina Travel to ensure accuracy of information when creating the flight reservations, issuance of tickets and other tour related documents including visa.
            3. Tour Member is also responsible to ensure that cleared of being blacklisted by regulatory bodies such as the Immigration Department, LHDN, banks, Insolvency Department and other bodies which may restrict the Tour Member from traveling abroad. Dina Travel will not be responsible for any refund, change or deferment of travel resulted from such restrictions.
            4. It is hereby agreed that Dina Travel shall not be held responsible or liable for any loss of passport due to any reason whatsoever including but not limited to negligence on the part of Dina Travel, its employees, agents and servants.
          2. Visa
            1. Tour Member is responsible to process and apply their own visa. Where visa fees are included in the tour price, Dina Travel will deduct the visa fees in the invoice.
            2. The visa fee exchange rate will be based on USD1 = MYR4.80. Whenever the exchange rate exceeds this value, the Tour Member will have to bear the difference for the visa application fee.
            3. Where the visa application is rejected or delayed approval by the foreign mission (which could result the Tour Member missed the trip), Dina Travel shall not be held liable or responsible for any refund over the tour price paid.
          3. Travel Insurance
            1. Dina Travel does not provide any travel insurance coverage to the Tour Members in any of the series and ad hoc group tour, unless specified otherwise in the tour program.
            2. Dina Travel strongly advise all Tour Member to purchase travel insurance coverage for their own trip before the trip.
            3. Travel insurance is mandatory as advised by the Malaysian Travel & Tour Association (MATTA). For indemnification, in the event of the Tour Members already have insurance coverage or refuses to purchase travel insurance; Tour Members are required to sign a disclaimer statement to indemnify Dina Travel for any unfortunate circumstances that may arise while on tour. Such indemnity form will be provided by our Agent Support department for Tour Members completion prior to the departure of the tour.
            4. Tour Member may be denied travel in the event such Indemnity Form is not signed and returned to Dina Travel prior to the departure. Where such denied travel occurs, Dina Travel is not liable to any refund or change of travel.
14. Dina Travel’s Rights & Responsibilities
          1. Dina Travel and/or its associated agents act only as an agent for the transportation companies, hotel contractors and other principles. tickets, vouchers and documents issued are subject to their terms and conditions under which the services are provided.
          2. Tour Members participating in any tour shall be at their own risk. Dina Travel and/or its associated agents and tour operators shall not be held liable to any person, because of any of the followings:
            1. Inaccuracy, miss description or changes to any tour and its itinerary.
            2. Expenses due to delays or changes in transport services, sickness, weather, pandemic, strikes, war, quarantine, travel restriction or other causes.
            3. Any damage, loss of baggage(s) or other personal effects or accidents.
            4. Deportation or refusal of entry of Tour Members by immigration authorities due to possession of unlawful items or holding improper travel documents or any other causes which are considered as subversive by the local and foreign government concerned.
            5. Changes made independently by the customer, including additional costs or incurred losses, in the event of any cancellation or changes by the operator. All modifications are at the customer’s own risk, and Dina Travel disclaims any liability for potential losses or claims that may arise.
          3. Where situation of clause 14 (b) occurs, Dina Travel will assist to provide all the necessary documents needed for travel insurance claim and assist to submit if the travel insurance is included in the tour price.
          4. Difficult and uncooperative Tour Member(s) whose act and conduct are unreasonable and detrimental to the enjoyment, interest, well-being and safety of the other Tour Members and the smooth-running of the tour in general will be dealt with by the Tour Manager/Leader. The Tour Manager/Leader may use his/her discretion and request the difficult Tour Member(s) to leave the tour group and The Tour Manager’s decision is final and conclusive. Dina Travel will not refund any uncompleted tour or part of the tour resulted from such dismissal.
15. Usage of Group Image, Photo and Video
          1. Dina Travel during the group tours may take some photos, individual or group basis and/or produce video recordings, herein after referred to as “Marketing Materials” for the purpose of the followings but not limited to:
            1. Dina Travel/ Suppliers/ Agents websites.
            2. Booklets, magazines or flyers.
            3. Social media including Facebook, Instagram, YouTube and Tik Tok.
            4. Mass media including TV or radio programs and/or advertisements.
            5. Printed or electronic billboard advertisements.
            6. Trade fairs or events printed or electronic materials.
          2. The participated agents in a group tour have the rights to use the group’s photos or video recordings as their Marketing Materials.
